Thank you for choosing to be part of our community at Small Trading Company Limited, the 'data controller' for and doing business as Destash ("Destash", "we", "us", "our"). We are committed to protecting your personal information and your right to privacy. When you visit our website https://www.getdestash.com/ (the "Website"), use our mobile application, as the case may be (the "App") and more generally, use any of our services (the "Services", which include the Website and App), we appreciate that you are trusting us with your personal information. We take your privacy very seriously. In this privacy notice, we seek to explain to you in the clearest way possible what information we collect, how we use it and what rights you have in relation to it. We hope you take some time to read through it carefully, as it is important. If there are any terms in this privacy notice that you do not agree with, please discontinue use of our Services immediately.

This privacy notice applies to all information collected through our Services (which, as described above, includes our Website and App), as well as, any related services, sales, marketing or events.

Please read this privacy notice carefully as it will help you understand what we do with the information that we collect.

Information collection

We collect information when you use Destash. This includes information both voluntarily provided and automatically collected.

Information you provide to us

  • Account information. When you create a Destash account, you provide your phonenumber, email address and a username. You will be required to verify both the phonenumber and email address.

  • Content information. You provide content information when you buy or sell a product Application. For example, when you sell an item you will upload one or more images or that item and provide information relevant to its sale.

  • Payment information. It is a requirement to provide a valid payment method before you can initiate a purchase or a sale on the Destash plaftorm. This is done by creating your Destash wallet.

  • Information from actions taken. We collect information about your use of Destash and your activities on the platform. This includes users you follow, purchases and sales you make, photos taken, images uploaded, conversations you have and other related actions.

  • Information used to enable optional features. Some features, such as contact synchronization and push notification may require that you grant / provide access to additional information to allow them to function correctly.

  • Other information you provide directly to us. You may optionally submit information directly to when you participate in Destash activities such as surveys or when you contact our support team.

Information we collect automatically

We also collect information automatically when you use Destash. This includes:

  • Information about your device. We collect information about then device you use to access the Destash platform. For example, this includes you IP address, operating system information, browser information, device id and device settings such as your camera.

  • Information about your use of the app and / or website. We collect and log event information related to how you interact with our app and / or website. This includes screens / pages you visit and activities you engage in and content you interact with.

We use cookies. First-party cookies are placed by us to allow you to use our services and to help us analyze and improve your experience. You can control usage of these cookies. Our services use the following types of cookie:

  • Strictly Necessary Cookies. We use a cookie to store your selected cookie preferences to meet our legal obligations. If you use tools to disable this cookie, parts of the website may not work and you may continuously be asked to set your cookie preferences.

  • Performance Cookies. We use cookies to allow us or our third-party analytics providers to learn how you and others use and engage with our services so we can understand and improve them.

Information usage

We process your information for purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, and/or your consent.

For legitimate business interests

  • To protect our services. We use your information as part of our efforts to keep our services safe and secure (for example, for fraud monitoring and prevention), to prevent misuse and to enforce our Terms of Service and other policies, and to comply with legal and regulatory requirements or in connection with our contract.

  • To personalize our services. We use your information to personalize our services. This information powers our home screen and other similar features so that you see relevant products or content first.

  • To improve our services. We use your information to help us understand how our users interact with our services, what screens, features and content they prefer and to assist us in improving the services we provide.

  • To facilitate payment processing. If you choose to link your account with us to a third-party account (such as your PayPayl account), we use the information you allowed us to collect from those third parties to facilitate payment processing.

To fulfill our contract with you

  • To provide you with our services. We use your information to provide you with the Destash services. For example we may use your information to fulfill and manage your orders, payments, returns, and exchanges made through the services. When you enable optional features, we use information from those services to power the feature.

  • To meet our commitments to the Destash community. We use your information to help make Destash a safe and positive community. We take action against users and content which violates our Terms or Service and or other policies.

  • To contact you. We use your personal information to send you product, service and new feature information and/or information about changes to our terms, conditions, and policies.

  • To provide customer service. We use your information to respond to your inquiries and solve any potential issues you might have with the use of our services. */}

For compliance with our legal obligations

We retain and use your information to respond to legal requests and prevent harm. If we receive a legal request, we may need to inspect the data we hold for a user to determine how to respond. Also, we may request addition information to confirm you identity when we receive a request to access, update or remove your personal information.

With your consent

We may also collect and use personal information with your consent.

Information disclosure

We may disclose information collected from users for the following reasons.

  • For legitimate interests. We may process your data when it is reasonably necessary to achieve our legitimate business interests.

  • For performance of a contract. Where we have entered into a contract with you, we may process your personal information to fulfill the terms of our contract.

  • To meet legal obligations. We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).

  • With your consent. We may process your data if you have given us specific consent to use your personal information for a specific purpose.

  • For vital interests. We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.

  • With our vendors, consultants and third-party service providers. We may share your data with third-party vendors, service providers, contractors or agents who perform services for us or on our behalf and require access to such information to do that work. Examples include: payment processing, data analysis, email delivery, hosting services, customer service and marketing efforts. We may allow selected third parties to use tracking technology on the Services, which will enable them to collect data on our behalf about how you interact with our Services over time. This information may be used to, among other things, analyze and track data, determine the popularity of certain content, pages or features, and better understand online activity. Unless described in this notice, we do not share, sell, rent or trade any of your information with third parties for their promotional purposes. We have contracts in place with our data processors, which are designed to help safeguard your personal information. This means that they cannot do anything with your personal information unless we have instructed them to do it. They will also not share your personal information with any organization apart from us. They also commit to protect the data they hold on our behalf and to retain it for the period we instruct.

  • For business transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

Information retention

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). No purpose in this notice will require us keeping your personal information for longer than six (6) months past the termination of the user's account.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

Information protection

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security, and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

Privacy control

We believe users should be able to control how their information is processed. Here are the ways in which you can control how we process your information.

  • Awareness of sales, purchases and uploading content. You choose which sales and purchases you participate in when using our services. You can choose what messages you send, photos you attach to items and general content you author. This content shared into a public space can be accessed by anyone.

  • Customization of settings and usage of features. Some features such as the ability to receive push messages and 'find your friends' require authorisation to be granted before any relevant data is accessed. Application settings can be used to enabled / disable the access to the data used by these features.

  • Account deletion. You can delete your account via the Profile screen when you have no active sales or orders. Deleting the account permanently deletes identifing information and anonymizes other information.

  • Access your information. If you see the information we collected from you, you can make a request using support@getdestash.com. We will respond to your request within 30 days.

Privacy rights

Users in the EEA, United Kingdom and Switzerland

In some regions (like the European Economic Area), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. In certain circumstances, you may also have the right to object to the processing of your personal information. To make such a request, please use the contact details provided below. We will consider and act upon any request in accordance with applicable data protection laws.

If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time. Please note however that this will not affect the lawfulness of the processing before its withdrawal, nor will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

If you are a resident in the European Economic Area and you believe we are unlawfully processing your personal information, you also have the right to complain to your local data protection supervisory authority. Account Information

If you would at any time like to review or change the information in your account or terminate your account, you can: Contact us using the contact information provided. Log in to your account settings and update your user account. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with applicable legal requirements.

Cookies and similar technologies: Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services. Users in California

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, and have a registered account with a Service, you have the right to request removal of unwanted data that you publicly post on the Services. To request removal of such data, please contact us using the contact information provided below, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Services, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g. backups, etc.).

Privacy policy updates

We will update this privacy policy from time to time. The updated version will be indicated by an updated "Last updated" date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification.
